These Terms of Service (“Terms”) govern your access to and use of the Aiper India Website and the products and services offered through it. The Website is operated by [Cavitak Marketing Pvt Ltd] (“Aiper India”, “Aiper”, “we”, “us” or “our”).

By browsing the Website, creating an account, placing an order or using our Services, you agree to these Terms and the policies incorporated into them, including the Privacy Policy, Shipping Policy, Return, Refund & Exchange Policy and Warranty & Support Policy.

1. Eligibility and Lawful Use

You must be legally capable of entering into a binding agreement under applicable law. Information you provide must be accurate and current. The Website may be used only for lawful purposes and in compliance with applicable laws.

2. Accounts and Security

Where an account is required, you are responsible for maintaining accurate account information and protecting your credentials. Notify us promptly of suspected unauthorised access. We may suspend or terminate accounts used fraudulently, unlawfully or in material breach of these Terms, subject to applicable law.

3. Products and Availability

We make reasonable efforts to keep product descriptions, images, specifications, prices and availability accurate. Product appearance may vary by display/device. Products are subject to availability, and we may correct errors, limit quantities or discontinue products subject to applicable law.

4. Orders and Acceptance

Placing an order is an offer to purchase. An order acknowledgement confirms receipt and does not necessarily constitute final acceptance. Orders may be subject to payment authorisation, stock availability, address/serviceability, fraud checks and verification of pricing or product information.

We may cancel an order where a product is unavailable, payment cannot be authorised, delivery is not serviceable, there is an obvious pricing/product error, or the order appears fraudulent or unlawful. If payment was received for a cancelled order, the applicable refund will be processed in accordance with our policy and applicable law.

5. Prices, Taxes and Payment

Prices are displayed in INR. Applicable GST and other taxes will be handled in accordance with Indian law. The final payable amount will be displayed before purchase. Payment is processed through the methods available at checkout, including third-party payment providers.

6. Shipping and Delivery

Shipping and delivery are governed by our Shipping Policy. Delivery timelines are generally estimates unless expressly stated otherwise.

7. Cancellation, Returns, Refunds and Warranty

Cancellation, return, refund, exchange and warranty matters are governed by the relevant Aiper India policies. Nothing in these Terms excludes or restricts statutory consumer rights. Where a remedy is required under applicable law or policy, it may include repair, replacement, refund or another appropriate remedy.

8. Product Use and Safety

Use Aiper products in accordance with the user manual, safety instructions, intended purpose and applicable laws. Do not bypass safety mechanisms, misuse products, use incompatible or unsafe accessories, or perform unauthorised repairs or modifications.

9. Intellectual Property

The Website and its content—including Aiper trademarks, logos, product names, images, videos, text, graphics, software, design and documentation—are owned by or licensed to Aiper or its affiliates/licensors. No ownership rights are transferred to you.

You may use Website content only for lawful personal, non-commercial purposes related to Aiper products. Unauthorised reproduction, scraping, distribution, commercial exploitation, modification or reverse engineering is prohibited.

10. Reviews and User Content

If you submit reviews, ratings, photographs, videos, comments or feedback, you are responsible for ensuring the content is lawful, accurate and does not infringe another person's rights. To the extent permitted by law, you grant Aiper a non-exclusive, worldwide, royalty-free licence to use such content for operating, improving and promoting our Services. We may remove content that violates these Terms or applicable law.

11. Third-Party Services and Links

The Website may use or link to third-party payment, logistics, analytics, support, social-media and other services. Their own terms and privacy policies may apply. Aiper does not control third-party services, subject to applicable law.

12. Website Availability and Errors

We seek to maintain the Website but do not guarantee uninterrupted, error-free or continuously available operation. Website information may occasionally contain technical, pricing, product or availability errors. We may correct errors and, where an error materially affects an order, provide an appropriate resolution in accordance with applicable law.

13. Liability

To the maximum extent permitted by law, Aiper will not be liable for indirect, incidental, special or consequential losses arising solely from use of the Website. Nothing excludes or limits liability that cannot legally be excluded, including statutory consumer rights, fraud, wilful misconduct or applicable product-liability obligations.

14. Indemnification

To the extent permitted by law, you are responsible for losses or third-party claims arising directly from your material breach of these Terms, unlawful use of the Website, infringement of intellectual property rights, fraud or intentional misuse. This does not transfer liability for Aiper’s own unlawful conduct or non-transferable statutory liability.

15. Suspension or Termination

We may suspend or restrict access where reasonably necessary because of unlawful use, fraud, security risks, material breach or legal requirements. Suspension or termination does not affect rights or obligations accrued before termination.

16. Force Majeure

Aiper will not be responsible for delay or failure caused by circumstances beyond reasonable control, including natural disasters, severe weather, government restrictions, strikes, transportation/infrastructure failures, civil disturbances or major third-party cybersecurity incidents.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Subject to applicable law, disputes shall be subject to the jurisdiction of competent courts at Ahmedabad, Gujarat, India. Nothing restricts a consumer's statutory right to approach a competent consumer commission, court or authority.

18. General and Changes

If any provision is invalid or unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver. We may update these Terms to reflect changes in services, technology, operations or law. The revised version will be published with the updated date.
